課程概述 |
This module examines key aspects of commercial law in England and Wales, drawing, where relevant, on materials from other jurisdictions and materials prepared under international commercial law. It will also critically consider in detail other regimes such as the Vienna Convention on the International Sale of Goods as well as proposals for the future development of this area of law (such as the proposed Common European Sales Law). The focus will be on major doctrines such as agency, assignment, sale of goods, and arbitration. Stress will be laid on the practical implications of the rules of commercial law, together with more theoretical issues. The module aims (a) to give you an understanding of different aspects of commercial law; (b) to encourage you to think practically in this field and apply the legal rules and principles they have learned to specific commercial situations; and (c) to enable you to identify and evaluate issues within commercial law. |
課程目標 |
On successful completion of this module, students should be able to:
Module-specific skills
(1) demonstrate a good understanding of the main areas of commercial law in the EU and England and Wales, and be able to discuss the practical and business context in which they operate;
(2) demonstrate critical awareness of relevant issues, and identify and analyse critically legal problems in the commercial law context; and
(3) demonstrate awareness of pragmatic, commercial, moral, policy and/or other issues in this field.
Discipline-specific skills
(4) identify and evaluate critically legal data from more than one source or jurisdiction;
(5) analyse and apply legal data to specific facts and deduce likely outcomes where law is indeterminate;
(6) demonstrate independent legal research and study skills; and
(7) identify, select and organise materials and produce coherent and convincing arguments.
Personal and key skills
(8) demonstrate effective written and oral communication skills;
(9) demonstrate sound paper-based and electronic research skills; and demonstrate effective team skills.

課程要求 |
Assessment is by an essay (25%) AND an examination (75%). More details will be provided in due course. The examination will be a closed note one although a statute book is permitted. |
